My aim in this paper is to explore the notion that corporations have moral rights within the context of a constitutive rules model of corporate moral agency. The first part of the paper will briefly introduce the notion of moral rights, identifying the distinctive feature of moral rights, as contrasted with other moral categories, in Vlastos' terms of overridingness. The second part will briefly summarize the constitutive rules approach to the moral agency of corporations (à la French, Smith, Ozar) and (...) pose the question of the paper. The third part will argue that, since the moral agency of corporations is dependent on the choices of those whose acceptence of the relevant rules constitutes the corporation as a moral agent, the rights of corporations are conventional; that is, they exist because they are so created. Thus, as a first answer, corporations do not have moral rights.But this raises a further question which we must explore. Once a corporation has been constituted, by the acceptance of the relevant rules by the relevant persons, does the corporation then have rights which endure? Can those who have constituted a corporation with certain rights morally change or cancel those rights in medias res without doing some sort of moral violence to the corporation? Redish et al. trace vulnerabilities in habit and planning systems almost exclusively to pharmacological effects of addictive substances on underlying brain systems. As we discuss, however, these systems also can be disrupted by purely psychological factors inherent in normal decision-making and everyday behavior. A truly unified model must integrate the contribution of both sets of factors in driving addiction.

Purpose: Our aim was to determine if self-determined motivation (SDM) in elite, men’s soccer changes over time and differs as a function of age, skill-grouping, and engagement in soccer play and practice. We tested predictions from the Developmental Model of Sport Participation (DMSP) regarding relations between practice and play and SDM among both elite and non-elite samples. Methods: Elite youth soccer players in the UK (n = 31; from the Under 13/U13 yr and U15 yr age groups) completed practice history (...) and motivation questionnaires at time1 (T1) and ~2 years later (T2: now U15 yr & U17 yr). Non-elite players (n = 32; from U15 yr and U17 yr) completed the same questionnaires at T2 only. Results: For the elite groups, global SDM decreased over time for the current U17 group (from U15), but no change was seen for the current U15 group (from U13). Age group differences at T2 mirrored these data, with U17 players showing lower global SDM and higher controlled motivation than U15 elites. The non-elite players did not show age group differences, but elites scored higher for global SDM and autonomous motivation than non-elites. The recent hours accumulated in practice negatively correlated with global SDM in elite and non-elite groups, but play was unrelated to measures of motivation. Conclusions: Differences in SDM as a function of age and skill point towards the dynamic nature of these motivations over time, likely a result of proximity to external rewards related to professional status. Although high volumes of practice are related to lower global SDM in both skill groups, the absence of any relations between SDM and soccer play does not support a key prediction related to the DMSP. HansenMy point of departure in this essay is the idea that creativity in teaching often has less to do with inventiveness per se than it does with responsiveness. To draw on terms from John Dewey, creative teachers "rise to the needs of the situation" presented in the educational setting.1 They respond well to circumstances not because they (...) necessarily have the pedagogical equivalent of Twyla Tharp's talent for choreography or B.B. King's brilliance on the blues guitar; rather, I want to suggest that creative teachers, at least in many cases, "rise" and do what is needed because they have learned to pay attention both to students and to the subject(s) at hand. In other words, I propose that we consider the idea that creativity in teaching often manifests itself most vividly, if also subtly, in a kind of ongoing attentiveness, by which I mean a dynamic combination of patience, listening, and initiative.I will begin the discussion by first sketching a conception of creativity in teaching centered around the idea of attentiveness. Then I address two [End Page 57] consequences of this conception. The first is that the most suitable models of good practice for new teachers to start with are not the profession's versions, presuming such exist, of Pablo Picasso, Marie Curie, or Michael Jordan. I do not mean that it is uniformly inappropriate to place such models in front of teacher candidates, any more than it would be wrong to put before art students the work of a Cassatt or Rembrandt. However, I will argue that among the best and most consequential initial models are those experiences in which teacher candidates themselves truly listened to the doings of the world around them and heeded what was said, whether the latter "spoke" in the form of a work of art, a human voice or gesture, or the play of wind in the trees. If new teachers take seriously this kind of experience, they can gain a valuable perspective for approaching the long and often difficult process of appreciating teaching's details and engaging them in educational settings. I illustrate these claims by examining a field-based activity that was part of a teacher education program I used to direct.The second consequence of the conception of creativity in teaching I will put forward points to the title of this essay. If new teachers deepen their ability to pay attention and to engage in creative work, they position themselves to receive one of teaching's primary offerings to its practitioners, namely, a life of meaning."Ordinary" Pedagogical CreativityCreativity in teaching can take many forms. We witness it in the structuring of an artful lesson plan; in the logic, flow, and pacing of a dynamic lecture; or in a timely and evocative example or illustration the teacher employs to clinch a point in the midst of a class. All of this is familiar and an important, indeed indispensable, way to think about good teaching. Creativity in practice is associated here, among other things, with notions of expertise and of knowledge gained through experience.However, I want to add to this portrait the notion that creativity in practice can also spring from responsiveness. Rather than issuing solely from what the teacher brings to the educational setting — consider again terms such as expertise and knowledge — creativity can point to what the teacher is capable of deriving or drawing from it. This paper examines Allen Carlson's influential view that knowledge from natural science offers the best (and perhaps only) framework for aesthetically appreciating nature for what it is in itself. Carlson argues that knowledge from the natural sciences can play a role analogous to the role of art-historical knowledge in our experience of art by supplying categories for properly ‘calibrating’ one's sensory experience and rendering more informed aesthetic judgments. Yet, while art history indeed functions this way, Carlson's formulation leaves out a (...) second (and often more important) role played by art-historical knowledge over the last century – namely, providing the context needed for interpretations of meaning. This paper explores whether natural science can also inform our aesthetic experience of nature in this second sense. I argue that a robust sense of meaning from our aesthetic experience of nature is indeed made possible by coupling our aesthetic experience of animals with knowledge from the natural science of animal ethology. By extending the scope of Carlson's analogy to include interpretations of meaning, my argument shows that the cognitive, scientific model can accommodate a wider range of aesthetic engagement with nature than previously recognised. The word “forgiveness” and its verbal form, “forgiving,” may appear to have one and the same meaning whenever it is used. But the first thesis of this essay is that several distinct kinds of human activity are denominated by this word, and their differences are philosophically important. The second thesis of this essay is that some of the human activities denominated by this word have a close connection with hope, more specifically with hoping-in-a-person. The third thesis of this essay is (...) that, because of this connection, some kinds of forgiving have important communal aspects that are often overlooked. Whether one believes that the embryo has rights from the instant of conception, or that the embryo has no moral rights at all, the conclusion about the fate of unused frozen embryos is the same: they ought to be preserved in their frozen state until they are implanted in a woman's womb or are no longer able to survive implantation.

The notion of group responsibility has received some very fruitful examination in recent years. But there still remains an important commonsense objection to this notion. Moral responsibility for an action is ordinarily linked to and held to depend upon the action's being the product of an act of choice on the part of the agent. The thrust of the objection here is that it is extremely difficult to understand how intentional acts like acts of choice can be properly attributed to (...) a group. The notion of a group "consciousness" does not seem a very satisfactory resolution of this problem. In this paper I shall propose that there are actually three distinct processes, as well as many hybrid combinations of them there, by which groups "make choices." That is, when we look at the activities of groups, we discover three different kinds of analogues to the act of choice of the individual person. I shall be illustrating each of these models with examples of health care decisions. In addition, I shall also try to illustrate how the level of personal moral responsibility of each of the individuals making up the group, i.e., each one's responsibility for the group's action, can be seen to flow from the particular role that an individual plays within the process of "group choice" that is involved. In this way, I hope to shed light not only on the topics of group choice, group responsibility, and the interplay of personal and group responsibility, but also to show concretely the valuable role that these themes can play in our understanding of the moral elements of the health care setting. In this article, David Hansen works with two conceptions of “being with.” The first is Jean-Luc Nancy's ontological version as found in his Being Singular Plural (1999). The second is Hansen's ontic formulation as expressed in his recent book, Reimagining the Call to Teach: A Witness to Teachers and Teaching (2021). Nancy's notion is ethical as well as ontological. It constitutes a vision of human being qua being and is formulated in critical juxtaposition with the viewpoints on ethics and (...) being of Martin Heidegger and other recent thinkers. Hansen's conception is not ontological, as such, but is ethical in the sense of presuming that teaching is a practice with built-in terms of relationship between teachers, students, and the subject matter of education, where “education” differs from socialization and enculturation. “Being with” constitutes a term of art for the priority in teaching of attunement, responsiveness, and receptivity — both to students and to subject matter — over formal processes of teacher reflection. The latter are indispensable, but they take their identity and their warrant from the fundamental ethical terms of the practice that are rooted in being with. Here, Hansen seeks to show how Nancy's conception of being with enriches the pedagogical idea of being with as the center and circumference of teaching. (shrink)

The social ethics of medicine is the study and ethical analysis of social structures which impact on the provision of health care by physicians. There are many such social structures. Not all these structures are responsive to the influence of physicians as health professionals. But some social structures which impact on health care are prompted by or supported by important preconceptions of medical practice. In this article, three such elements of the philosophy of medicine are examined in terms of the (...) negative impact on health care of the social structures to which they contribute. In this paper, I seek to develop Aquinas’s view of the passions’ contribution to moral reasoning by discussing the role he sees the passions as playing in each of practical reason’s three acts. I begin by outlining why, on Aquinas’s account, the passions are capable of contributing to moral reasoning. I then turn to his proposal in Summa Theologica I-II, q. 44, a. 2 that certain passions can improve the act of counsel. I also address what appears to be a (...) contradiction in his account. Next, I explain why Aquinas allows the passions to contribute to the act of counsel, but claims in De malo q. 3, a. 11 that they should not be given weight in our moral judgments. I end by briefly exploring whether Aquinas allows the passions to contribute to the act of command. I suggest that he does. (shrink)

In this article, I map current conceptions of cosmopolitanism and sketch distinctions between the concept and humanism and multiculturalism. The differences mirror what I take to be a central motif of cosmopolitanism: the capacity to fuse reflective openness to the new with reflective loyalty to the known. This motif invites a reconsideration of the meaning of culture as well as of the relations between home and the world.

Pluralism is an essential feature of liberal democratic theory and practice and rests upon the fundamental value of tolerance. Today, commitment to various forms of constitutional representative democracy appears to be widespread, and globilization has diminished the political, economic, and cultural significance of borders to some degree. But concurrently, in a trend which seems to have accelerated since the end of the Cold War, there has been a marked increase in many areas around the world of conflict, tormoil, and violence (...) rooted in ethnic, religious, and regional identities. This trend, a sort of 21st century balkanization, is a serious threat to pluralism. This chapter defines pluralism and argues for its advantages. It also presents an argument against one influential approach to handling identity-based activities and claims, which advocates recognition of special group rights and privileges. The chapter concludes with the proposal of conditions conducive to the well-being and expansion of pluralism, and with suggestions for the kinds of public policies likely to foster such conditions. -/- . The meaning and moral implications of voting and nonvoting in a representative democracy are outlined and discussed. A conception of voting as a forward-looking, conditional shared responsibility is developed and defended. This conception reflects an understanding of democratic politics in which the supreme strategic advantage is power to affect "the conflict of conflicts", that is, the ability to influence the shape and content of the dominant political agenda. This conception is also shown to support a consequentialist approach to distributive justice (...) and specifically, to require greater economic equality. (shrink)

In this article, I seek to illuminate the texture of moral experience. I pursue that aim through a close reading of David Lean's film, Brief Encounter, produced in 1946. The chief protagonist in the film undergoes a moral odyssey that reveals and tests all that she has understood about how to conduct a life. Her experience sheds light on the constituents of an individual moral sensibility as well as how its enactment appears in practice when one confronts a heartfelt (...) difficulty. I argue that moral experience is best understood through the idiom of narrative and character, rather than through ethical language that places formal or universal principle at the center of the moral life. In the workshop of the moral self, as Lean's protagonist reveals, the task is not to fashion or take on universal principles but rather to cultivate virtuous relations with other people in the here-and-now.
